Yet even though those arrangements are high-risk, they often get approved with higher credit ratings because the risky loans are channeled through seemingly safe wrappers, the Fed researchers said. The authors cited the frequent use of financial packages— such as broadly syndicated loans that involve a group of lenders to a single borrower; collateralized loan obligations backed by pools of debt; business development companies, which are organizations that invest in developing and / or distressed companies; and joint venture loan funds, which are pools of capital from two or more parties intended to finance one specific project.
In total, the carriers’ dependence on“ wholesale funding” is near where it was shortly before the financial crisis, the authors said. During the crisis, they recalled ominously, insurers experienced“ runs on their nontraditional funding structures.”
The NAIC isn’ t completely unaware of the dangers facing life insurance and annuities customers. In February, it issued a draft proposal for increasing scrutiny of offshore and captive reinsurance transactions. Rybka, however, calls the proposal“ weak kneed,” saying it“ lacked the teeth to rein in these transactions.” In an open letter to the NAIC, he wrote that the draft proposal was“ far from sufficient, let alone robust enough to afford real protection to policyholders.”
Considering the many potential risks facing annuity and life insurance holders, any real solution will have to be broadbased, multifaceted and ironclad, industry observers say. After all, the danger doesn’ t lie in any one problem so much as a combination of factors.“ It’ s the intersectionality between them,” says Michelle Gordon of MRG Advisors in New York City.
Qualified insurance advisors should check the creditworthiness of any insurance companies they recommend to clients, she says, though most don’ t or can’ t because of the lax ratings standards.“ The non-codification of insurance advisement results in sub-optimization of consumer protections,” she adds.
